smart-ALICE Terms & Conditions
These terms govern your use of smart-ALICE ("the App"), a mobile and web service that lets residents of Grenoble-Alpes Métropole give away used IT equipment to approved reuse-sector organisations, and browse, reserve and collect refurbished equipment from them. By creating an account you accept these terms. If you do not accept them, do not use the App.
How we handle your personal data is explained separately, in the Privacy Policy.
1. Who provides the App
DOTSOFT SA, Posidonos 71, 55535, Thessaloniki, Greece
G.E.MI. 059277904000 · VAT EL999566850 · [email protected]
DOTSOFT SA operates the App. smart-ALICE runs as a funded pilot for Grenoble-Alpes Métropole, the public authority for the area the pilot serves.
2. What smart-ALICE is, and what it is not
The App connects three kinds of user:
| Who | What they do |
|---|---|
| Donors and buyers | Offer a device for free collection, and browse, reserve and collect devices offered by organisations |
| Reuse-sector organisations | Collect donated devices, assess and refurbish them, certify them, and list them for reuse |
| Platform administrators | Approve organisations and monitor the pilot |
We are an intermediary, not a party to your transaction. When you give a device away or take one, the agreement is between you and the reuse-sector organisation. We provide the software that introduces you, tracks the device and records what happened. We do not own the devices, inspect them, refurbish them, certify them, set prices, or take part in the handover.
We handle no money. Where a device has a price, you pay it directly to the organisation — in cash, by bank transfer or by card at its premises — and the organisation records the sale in the App, with its receipt. No payment passes through the App.
3. Your account
You must be at least 18 years old to reserve or take a device. The App asks you to confirm this yourself and does not verify it. Confirming it falsely is a breach of these terms.
You agree to give accurate registration details, to keep your password to yourself, and to tell us promptly if you believe someone else is using your account. You are responsible for what happens under it. You must not create or use another account to evade a suspension or restriction.
Reuse-sector accounts work differently. An organisation registers its details and cannot sign in until a platform administrator approves it. Approval is at our discretion, and a decision is final — a rejected organisation should apply again only if its circumstances have materially changed. Section 9 sets out the extra obligations that come with these accounts.
Administrator accounts are created by us; there is no self-registration.
4. Giving a device away
When you offer a device, you confirm that:
- you own it, or are otherwise entitled to give it away;
- the category, brand, model, description and photos you provide are accurate, including any damage you know about;
- you have removed your own data from it — accounts, files, SIM and memory cards — before handing it over.
That last point matters, and the App does not do it for you. An organisation will normally wipe a device again before listing it, but do not rely on that: we are not responsible for data you leave on a device you have given away.
A reuse-sector organisation collects the device free of charge, at an address and time window you propose; the organisation may propose a different one. Either side may cancel a scheduled collection before it happens, and the App tells the other side.
Once a device is collected it is no longer yours. You cannot ask for it back, you are not paid for it, and you have no say in what happens to it. The App shows you what did happen — whether the device was refurbished and listed for reuse or sent for recycling — and the certificate issued for it.
We may refuse or remove an offer, and an organisation may decline a collection.
5. Taking a device
Listings are published by reuse-sector organisations, not by us. Some devices are free; others carry a cost-recovery price set by the organisation, and delivery may cost extra. Both are shown before you reserve.
Devices are second-hand. Each listing says whether the organisation offers a warranty and for how long; many carry none. Any warranty, and any legal guarantee arising from the transfer, is the organisation's, not ours.
When you reserve, you confirm that you are 18 or over and, for a free device, that you are taking it for genuine use and will not resell it.
Reservations are first come, first served. The first reservation locks the listing and takes the device off the marketplace immediately — there is no queue and no approval step. You may withdraw your reservation at any time until the organisation completes the purchase, which returns the device to the marketplace, and the organisation may cancel it as well; the App tells the other side either way.
You then arrange collection or delivery with the organisation and pay it directly if there is a price. The organisation completes the purchase in the App and attaches its receipt, and you then confirm in the App that you received the device, after which the App shows your receipt.
Disputes about a device, its price, the handover or a refund are between you and the organisation. Any mandatory consumer rights that apply to the transfer remain unaffected and must be respected by the organisation where applicable.
6. What you may not do
Do not use the App to:
- offer a device that is not yours, or that you know to be stolen, unsafe or counterfeit;
- misrepresent a device's condition, origin or specification;
- resell a device you took free of charge through the App;
- upload photos or text that are unlawful, obscene, hateful or harassing, or that show other people's personal information;
- harass, threaten or defraud another user or an organisation's staff;
- impersonate anyone, or use an account that is not yours;
- scrape, overload, probe or reverse-engineer the service, or try to reach data that is not yours.
There is no tolerance for objectionable content or abusive behaviour here, and accounts responsible for it are removed.
7. Photos and text you upload
You keep ownership of the photos and descriptions you upload. You grant us, and the reuse-sector organisation you are dealing with, a free, non-exclusive licence to store, display and reproduce them for the purpose of running the service — showing your device to the organisation, publishing the listing, and reporting on the pilot in aggregate. The licence ends when the content is removed, except for photos of a device that has been collected, which stay with the device's reuse history.
Upload only content you have the right to upload. Photos are stripped of hidden metadata, on your device by the mobile app and again on our servers, as described in the Privacy Policy.
8. Reporting a problem, and what we may do
If you see a listing, a photo or an account that breaks these terms, tell us at [email protected], with enough detail for us to find it. We review reports and take action where it is justified.
We may remove content, withdraw a listing, suspend or close an account, or refuse service, where we reasonably believe these terms have been broken, where the law requires it, or where users are at risk. We tell the affected user what we did and why, unless telling them would be unlawful, and they can contest the decision by replying to that message or writing to the address above.
9. Reuse-sector organisations
If you hold a reuse-sector account, you also agree that:
- you are a legally constituted organisation entitled to operate in the reuse sector in your area, and the details you registered are accurate and kept current;
- you collect the devices you have accepted, or cancel promptly so the donor is not left waiting;
- you erase donors' data from devices before assessment, and you certify, list and describe devices honestly, including their condition and any warranty;
- prices are cost-recovery and set by you; you collect payment yourself, and invoicing, taxes and any consumer-law obligation arising from the transfer are yours;
- the personal data of donors and buyers that the App discloses to you, so that you can complete a collection or handover, is yours to protect as an independent controller under the GDPR;
- your account is used only by your own authorised staff.
We may suspend an organisation's account where these obligations are not met.
10. Availability, and the pilot
smart-ALICE is a pilot. We provide it as it is, with no promise of uninterrupted availability, and we may change, suspend or withdraw features while the pilot runs. We aim to give reasonable notice of anything that affects a donation or reservation already in progress. When the pilot ends, the App may be withdrawn; personal data will then be handled in accordance with the Privacy Policy and applicable law.
11. Our responsibility
We are responsible for operating the App with reasonable care. We are not responsible for:
- the condition, safety, legality, description or performance of any device — those are matters between you and the organisation;
- whether an organisation collects, refurbishes, delivers, or honours a warranty;
- data you leave on a device you have given away;
- what another user does, on or off the App;
- interruptions or loss of data caused by events outside our reasonable control.
So far as the law allows, we are not liable for indirect or consequential loss, lost profit, or lost opportunity. Nothing here excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded by law — including your mandatory rights as a consumer, which these terms do not affect.
12. Intellectual property
The App, its design, code, name and logo belong to DOTSOFT SA or its licensors. You have a personal, revocable, non-transferable licence to use the App for the purposes described here. Nothing is assigned to you, and you may not copy, adapt or redistribute any part of it.
13. Ending your use
You may stop using the App at any time. If you have a donor/buyer account, you can delete it yourself, under Profile, Delete account — you are asked to confirm first, and deletion then takes effect immediately and cannot be undone. You can also ask us to delete your account for you, by writing to [email protected] from the address your account uses. Either way, the Privacy Policy explains what is deleted and what is kept. Settle any donation or reservation already in progress with the organisation first.
We may close your account for a serious or repeated breach of these terms, with notice unless the law or the safety of others prevents it.
14. Changes, law and disputes
We will update these terms when the service changes, publish the new version with a new date, and announce material changes in the App. Continuing to use the App after a change means you accept it.
These terms are governed by Greek law, and the courts of Thessaloniki, Greece have jurisdiction. If you are a consumer resident in France, this does not deprive you of the protection of the mandatory rules of French law, and you may also bring proceedings before your own courts. Nothing in these terms limits any mandatory consumer-protection or dispute-resolution route available to you under applicable law.
